PROVO, Utah — A judge in Utah said he will rule Monday on whether prosecutors in the murder case of conservative activist Charlie Kirk could face sanctions for their comments to the media about evidence in the case.

The decision by 4th District Court Judge Tony Graf comes after defense attorneys for Tyler Robinson, the 23-year-old man charged with aggravated murder in Kirk's killing, sought sanctions including removal of the death penalty as a possible punishment.

Robinson is accused of fatally shooting Kirk on Sept. 10, 2025, while the activist was addressing a crowd at Utah Valley University in Orem, Utah. Kirk, a prominent conservative figure and founder of Turning Point USA, was shot in the neck and pronounced dead at a hospital.

Prosecutors from the Utah County Attorney's Office have said they intend to seek the death penalty if Robinson is convicted. The defense argued that comments by prosecutors to reporters about a bullet fragment recovered from Kirk's body violated a gag order and prejudiced the case.

Deputy Utah County Attorney Christopher Ballard testified on June 12 that he spoke to the media to counter what he described as mischaracterized information about the bullet evidence. Ballard said his remarks were intended to address misinformation.

Defense attorneys have pushed for significant consequences, including disqualifying the prosecutor's office or barring the death penalty. Earlier this year, Judge Graf rejected a defense motion to disqualify prosecutors over an alleged conflict of interest involving a family member of one prosecutor who witnessed the shooting.

The case has drawn significant attention, with proceedings open to the public and media following prior court rulings.

Robinson faces multiple charges, including aggravated murder, witness tampering and obstruction of justice. He surrendered to authorities the day after the shooting.
