High Court Bars Arya Samaj Temple From Solemnising Marriages

PRAYAGRAJ — The Allahabad High Court has directed that an Arya Samaj temple involved in a case before it must not solemnise marriages until it complies with applicable legal requirements, while expressing concern over the conduct of ceremonies and issuance of marriage certificates without adherence to statutory procedures.

The order was passed while the court considered a petition linked to a marriage conducted at an Arya Samaj temple. The bench examined whether the institution had acted in accordance with the legal framework governing Hindu marriages and the issuance of marriage-related documents, according to the court's order.

The court said marriages must comply with the requirements of the Hindu Marriage Act and other applicable laws, stressing that the performance of a ceremony or the issuance of a certificate by itself cannot substitute for statutory compliance where the law prescribes specific conditions. It directed that the temple refrain from solemnising marriages until it satisfies the legal standards identified in the proceedings.

The bench also called attention to broader concerns over the functioning of certain Arya Samaj institutions that conduct marriages and issue certificates, particularly in cases involving disputes over age, consent or compliance with personal law. The court observed that such practices could give rise to legal complications if statutory safeguards are not followed.

The ruling follows earlier judicial scrutiny of marriages conducted through Arya Samaj institutions. In a 2025 decision, the Allahabad High Court held that interfaith marriages conducted without compliance with the applicable legal framework were not valid under the governing personal laws and directed the Uttar Pradesh home secretary to investigate the manner in which some Arya Samaj temples were issuing marriage certificates.

Indian courts have consistently held that a Hindu marriage must be solemnised in accordance with the customary rites and ceremonies recognised under Section 7 of the Hindu Marriage Act. Courts have also clarified that a certificate issued by an Arya Samaj institution may serve as evidence that a ceremony took place but does not, by itself, conclusively establish the legal validity of a marriage if the statutory requirements have not been met.

The latest order does not alter the legal position governing valid Hindu marriages but reinforces the obligation of institutions conducting such ceremonies to adhere strictly to the statutory framework.
