The U.S. Senate’s narrow confirmation of Todd Blanche as attorney general has converted President Donald Trump’s former personal lawyer from an acting head of the Justice Department into its Senate-confirmed leader, strengthening his formal authority while intensifying scrutiny over the department’s independence.
Blanche was confirmed 50-49 on Aug. 8, with Republicans Susan Collins and Lisa Murkowski joining Democrats in opposition. Republican Senator Bill Cassidy supplied the decisive vote after Blanche made written commitments concerning a controversial Justice Department initiative and related protections for Trump and his family. The unusually close vote underscores that the confirmation was not simply a routine exercise of the Republican Senate majority but a test of how much latitude lawmakers were prepared to give an attorney general closely associated with the president.
The immediate institutional change is significant. Blanche had already been running the department as acting attorney general since April, after Trump removed Pam Bondi. Before that, he served as deputy attorney general, a position the Senate confirmed in March 2025 by a 52-46 vote. As deputy, he was responsible for assisting the attorney general in supervising the department; as attorney general, he now holds the department’s top statutory leadership position.
That progression gives Blanche greater authority to set priorities across the Justice Department, including its criminal, civil and national-security operations. It also removes the temporary character of his leadership. The department can now operate under a permanent attorney general rather than an acting official whose tenure depends directly on the president’s continuing confidence.
The political significance, however, lies in how Blanche reached confirmation. His close relationship with Trump was central to the Senate debate. Before entering government, Blanche represented Trump in several criminal cases. That background has produced concerns among Democrats and some Republicans about whether the attorney general can maintain the traditional institutional separation between presidential political interests and federal law enforcement. Senator Dick Durbin, the senior Democrat on the Judiciary Committee, argued that Blanche had weakened the department’s independence; Republican supporters countered that his prosecutorial experience and familiarity with the administration’s priorities made him qualified to lead it.
The confirmation fight also demonstrated that Senate Republicans retained some capacity to impose constraints on the administration even while controlling the chamber. The most consequential dispute involved a roughly $1.8 billion “anti-weaponization” fund created through a Justice Department settlement involving Trump’s lawsuit against the Internal Revenue Service. Republican senators had objected to the arrangement, while Democrats questioned whether it could channel taxpayer money toward people aligned with Trump. Blanche subsequently announced that the department would rescind the fund, helping secure support from Republicans including John Cornyn and Thom Tillis.
The episode matters because it established a precedent for how Blanche may navigate the competing demands of the White House and Congress. His confirmation demonstrates that loyalty to the president was not, by itself, sufficient to secure unanimous Republican support. At the same time, the concessions were enough to preserve the nomination, suggesting that Republican resistance focused on particular policies and legal arrangements rather than on rejecting Blanche’s broader leadership of the department. Cassidy, who had previously joined a bipartisan legal challenge to the fund, ultimately supported confirmation after Blanche’s commitments.
The Epstein investigations and document releases represent another area where Blanche faces continuing congressional scrutiny. At his July confirmation hearing, he told senators that the department had reviewed more than six million pages of material under the Epstein Transparency Act and was investigating leads supplied by victims. Democrats have questioned the department’s handling of the records and Blanche’s actions while serving as acting attorney general.
For the Justice Department itself, the confirmation therefore changes both authority and accountability. Blanche can now pursue the administration’s stated law-enforcement priorities with the institutional status of a confirmed cabinet official, while Congress has a clearer target for oversight. Supporters point to his emphasis on violent crime, immigration enforcement, drug organizations and fraud as evidence of an operational agenda focused on public safety.
The central unresolved issue is whether Blanche’s permanent tenure will alter perceptions of the department’s independence or reinforce them. His confirmation does not settle that question. What is established is that he now has the full authority of the attorney general after a closely contested Senate vote, while congressional scrutiny over his handling of politically sensitive investigations, settlement agreements and Justice Department policy is likely to continue.
